SUGAR ELVES operates as a cottage food production business in the State of Texas.
All products are prepared in a private home kitchen and are not subject to inspection by the Texas Department of State Health Services or a local health authority, as permitted under Texas Cottage Food Law.
By placing an order, you acknowledge and accept that our products are made in a home kitchen operating in compliance with Texas cottage food regulations.

Allergen & Dietary Disclaimer
Because our products are made in a home kitchen under Texas Cottage Food Law, and are not produced in a commercial facility, certain labeling and safety standards differ from restaurant or commercial food production. As required by Texas cottage food regulations:
Our products may contain major food allergens such as eggs, milk, wheat, soy, peanuts, tree nuts, sesame, fish, shellfish, or other allergens if they are present in the recipe, and we disclose those on the product label where required.
Any major food allergen present in a product will be listed on the label of that item.
Please note:
Because we operate under the Texas cottage food law, we do not accommodate dietary restrictions, special dietary needs, or allergen requests (such as gluten-free, dairy-free, vegan, etc.). Products may be prepared on shared surfaces and with shared equipment, and cross-contact with allergens can occur.
By placing an order with us, you acknowledge and accept that:
Our products are not formulated or tested to meet special dietary requirements.
We cannot guarantee the absence of any specific allergen not disclosed on the label.
You are responsible for determining whether ingredients or products are safe for your use based on your own dietary needs.
The Client is responsible for informing Sugar Elves of any allergies within 24 hours of receiving an Invoice or Order Confirmation. To contact Sugar Elves please email info@sugarelves.com with your Invoice or Order Number and include any allergies.
The Client is responsible for indicating to guests’ potential allergy hazards, and Sugar Elves will communicate its ability to accommodate restrictions.
Changes to Order
Any changes must be submitted 1 week prior to delivery or pick-up. Any changes made afterwards may be incorporated at the discretion of Sugar Elves and may include an additional fee, or require deposit (or additional deposit).
There will be no changes allowed within 48 hours of delivery or pick-up.
Changes for large or customized orders (such as Cakes, Cookie Cakes, or orders with custom flavors, packaging, or any other customizations not offered on our Regular Menu or Seasonal Specials Menu) must be made within 24 hours of "Order Acceptance" or given deadline. It is the Client's responsibility to inform Sugar Elves of any desired changes. Failure to notify Sugar Elves will not result in a refund at the time of delivery/pick-up.
Order Cancellations (and Refunds)
Failure to receive delivery for, or pick up, an order that is Paid In Full will not result in a complete refund. Partial refunds may be considered on a case by case basis.
If there is a defect in your product please contact Sugar Elves via email info@sugarelves.com. A proportionate refund will be given if we determine there is a quality deficiency. Sugar Elves retains the right to judge our product quality for ourselves. A refund of any amount is not guaranteed.
If you try one of our products and just don't care for it, we hope you try something different next time; however, a refund will not be given.
Cancellations for large or customized orders (such as Cakes, Cookie Cakes, or orders with custom flavors, packaging, or any other customizations not offered on our Regular Menu or Seasonal Specials Menu) must be made within 24 hours of "Order Acceptance". It is the Client's responsibility to inform SUGAR ELVES of any special circumstances that cause a cancellation of this order type, at which time, a refund of any deposit can be considered, but is not guaranteed.
No refund will ever be given for an amount in excess of the original purchase price regardless of circumstance.
Deposits and Payments (Large and Customized Orders)
A 50% non refundable deposit is due at the time of placing the order to reserve the date of pickup/delivery on all products. Remaining balance is due 1 week prior to event/pickup date.
A $100 non refundable deposit is due on all orders over $450 and will require a signed contract. Remaining balance is due 1 month prior to event date.
The date of delivery or pick-up is considered “booked” upon receipt of a non-refundable deposit equaling 50% of the total value of the custom order.
The final payment is due 7 days prior to the delivery/pick-up date, unless otherwise communicated.
If the Client fails to make any required Deposit, or Installment, Payment(s), SUGAR ELVES will cease work, the order will be cancelled, and no refund of any amount will be given.
Liability
SUGAR ELVES is not responsible for bodily injury, property or any consequential damage which may result from products/services provided.
SUGAR ELVES is not responsible for any damage to the goods/services provided after delivery/pick-up of the product(s) has been completed
Content
SUGAR ELVES reserves the right to use all photographs, videos, and any other content of the customers order for advertising purposes unless otherwise requested and agreed upon mutually at the time of the customer placing an order.
Communication
All communications with SUGAR ELVES are to be made through email, or direct messaging.
If you placed a custom order and received an Invoice, all communication should be made through email or by phone (when applicable).
Deposits and Payments are made via Venmo or Square
SUGAR ELVES RESERVES THE RIGHT TO MODIFY ITS TERMS AND CONDITIONS POLICY AT ANY TIME WITHOUT NOTICE.
